Yes. If 3. Kh3 (or Kh4), then black plays 3...Qh1+ and a threefold repetition draw quickly ensues.

Whites's only other legal moves are 3. Qe2 (undesirable for obvious reasons), and
3. Kf5 Qh5+
4. Ke4 Qxb5

So white has to settle for perpetual check or lose the queen.
