Black is trying to avoid the stalemate, when it becomes obvious that white will force it due to threefold repetition black takes the queen.

zairinho is correct. If the king takes the queen, Black has no legal moves and it is a stalemate.

if your question was, why not this series of moves, the reply will of course be

3. Rxh3+ Kh3 4. Qg3+ Kxg3 which is a beautiful forced stalemate

in case others dont understand the previous comments made:

black has material advantage so white tries to force the stalemate, if 5. Qg3+ Kxg3 is played, this is stalemate (white has no legal moves remaining). 6. Qh4+ Kg2 7. Qg3+ Kxg3 shows that white will force a draw either by threefold repetition or through stalemate

i find it strange that white doesnt play 6. Qf3+, but then of course the result is the same anyway
