It would still work if the pawns on e2 & e3 were removed; and that would be a legal position

I'm afraid not; if the pawns weren't there, then K-d2 is an alternative solution.

There's probably a way around it that keeps the position legal, but I'm not too bothered. This position is about 0.0001% less likely to ever arise in a normal game, than if the 2 pawns were removed.
