re-instating a game
It is pretty straightforward. Have done it when it is a shame for a good game to end just because of a time-out.

A ) If you want to re-instate a game that you won because your opponent timed out, you ask him to reinstate the game.

B ) And if he is the first one to want to reinstate the game, he requests it:
where-upon a new game appears, with the option for you to decline it.

Here is how GameKnot describes the procedure:

<<" The link to request to reinstate a timed-out game is included in the e-mail and the private message you receive after the game is over.
After you request to reinstate the game, a brand new regular (i.e. non-team, non-tournament, non-league, etc.) rated (i.e. it will also affect your rating and stats) game will be created with the same time control as the old one and starting with the last position on the board. Your opponent will be given an option to decline the reinstatement.
The old timed-out game will still be counted towards your rating and stats (including team rating, tournament standing, league stats, etc. etc.). In other words, reinstating a game doesn't restore your previous rating nor stats.

Please note that only the timed-out player can request the game reinstatement, and that each game can only be reinstated once. ">>

Reinstating games is great,as long as common sense is applied...
I think reinstating a game is a great idea for those who time-out,if both parties agree.I never have timed-out a game yet,but some of my opponents have.Keep in mind one thing however.....it may NOT always be a wise decision to ask your opponent reinstate a game that you have timed-out.
If,for example,you are losing a RATED game fairly badly before the time-out(or you are in a mating net) and you request a reinstated game from that same position after you time-out,it would not be the smartest idea to play from that same position again and lose DOUBLE rating points!For you lost points in the time-out and then will lose AGAIN from that same position.....another couple of points.So make sure you either have a good chance at winning or atleast drawing against a stronger opponent.If you manage a draw against a weaker opponent,you will probably lose atleast a point anyway on top of the time-out point loss.So are all those point losses worth it?Hmmmm...you decide.In non rated games,it dosen't matter,but thats a different story.

Not long ago on GK I had an opponent time-out on me.I had him in a mate in 4 or 5(I forget) and my opponent was going to lose the game.So he requested the game be reinstated,after HE timed-out.I refused.
Why?Because I actually felt sorry for the opponent!Why should I gain 5 points or so for him timing-out and then gain another 5 points when he loses to my positional mating net!?
So,I did him a favor by refusing to reinstate the game!
